Customer terms

Version 1.1 · in effect from 6 November 2026 · Plain text copy

Draft for pilot use. Review by a solicitor before relying on it.

These terms are the agreement between TutorMaestry ("TutorMaestry", "we", "us"), of [CONFIRM: address], and the business or person who opens a TutorMaestry account ("you"). They apply from the moment you tick the box to agree to them. The Data processing agreement forms part of these terms.

If you are agreeing for a business, you confirm you are allowed to bind it. TutorMaestry is for businesses and self-employed tutors, not for consumers acting for themselves.

1. What TutorMaestry is

1.1 TutorMaestry is online software for running a tutoring business: families and pupils, lessons and calendar, invoices and payments, session notes and progress reports, and (on some plans) a family portal, messaging, AI features and more. We provide the software as a service; we do not provide tutoring, and we are not party to your agreements with your families.

1.2 Each customer has their own instance: your own application, database, storage and backups, separate from every other customer's.

1.3 We may improve, change or remove features. We will not make a change that materially reduces what your paid plan includes during a period you have already paid for. Where a change matters to you, we tell you first.

2. Your account

2.1 You are responsible for who you let sign in, for keeping sign-in details secret, and for everything done in your account. Tell us straight away at [CONFIRM: support email] if you think someone has got in who should not have.

2.2 The person who accepts these terms is the account owner. Only the account owner can change the plan, accept new versions of these terms, or close the account.

3. Free trial

3.1 A new account starts with a free trial of the Pro plan for 14 days. No card is needed.

3.2 The trial includes a smaller AI allowance than paid Pro, to keep it free for everyone.

3.3 When the trial ends and you have not chosen a plan, your account moves to the Free plan. Nothing is deleted. Anything beyond the Free plan's limits becomes read-only until you choose a bigger plan (section 5).

4. Plans and fees

4.1 The plans and what each includes are shown on the Plan and billing page in the app. Introductory pilot pricing:

Plan Monthly Yearly (two months free)
Free £0 £0
Starter £12 £120
Pro £25 £250
Plus £45 £450

4.2 Prices exclude VAT, which is added where it applies. These prices are provisional pilot pricing.

4.3 A paid plan is charged in advance, monthly or yearly, and renews automatically for the same period until you cancel. Payment is taken by our payment provider (Stripe); your card details never reach TutorMaestry.

4.4 If we change a price, we tell you at least 30 days before it applies to you, and it applies from your next renewal after that. You can cancel before then.

4.5 If a renewal payment fails, the plan stays usable for a few days while the payment is retried. If it still fails, your account moves to Free (section 5). Nothing is deleted.

4.6 Fees already paid are not refundable for part of a period, except where the law says otherwise or where we end these terms without your having broken them (section 11.3).

4.7 There are no fees from TutorMaestry on the payments your families make to you. Your payment provider may charge its own fees.

5. Moving between plans, and the Free plan

5.1 You can upgrade at any time; the bigger plan applies at once.

5.2 You can move to Free, or cancel a paid plan, at any time from Plan and billing. Your paid plan ends then and you move to Free.

5.3 On Free, or any time your account is above the limits of its plan: nothing is deleted; pupils above the plan's limit stay readable with their lessons and invoices, but new lessons can't be added for them; the family portal stops letting families in, and families see a message asking them to contact you; AI features stop; and features the plan does not include are paused. Choosing a bigger plan restores all of it straight away.

5.4 It is your responsibility to tell your families if a change of plan affects them (for example, if the family portal stops working).

6. Your data

6.1 Your data is yours. "Customer data" means everything you or your families put into TutorMaestry. You keep all rights in it.

6.2 For the personal data in customer data (about your families, pupils and anyone else), you are the controller and TutorMaestry is your processor. The Data processing agreement sets out how we handle it, and it forms part of these terms.

6.3 You are responsible for having a lawful basis to put personal data into TutorMaestry, for giving your families a privacy notice, and for any consent you need, in particular before recording a pupil's health or special educational needs information.

6.4 You can export your data at any time from the app, on every plan, including after a paid plan ends.

6.5 We do not sell customer data, use it for advertising, or use it to train AI models.

6.6 We may collect anonymous, aggregated information about how the service is used (for example, how many invoices are created), which identifies no one, to run and improve the service.

7. Acceptable use

You must not use TutorMaestry to break the law; to upload anything you have no right to upload; to send unsolicited marketing; to attempt to get into another customer's data or any part of the service you are not meant to reach; to probe, scan or test its security without our written agreement (report a weakness to us instead: Support policy); to overload it or interfere with it; or to copy, resell or reverse-engineer it, except where the law allows. You must use the AI features only for your tutoring business and check what they produce before relying on it or sharing it.

8. Availability and support

8.1 We aim to keep TutorMaestry available at all times, but it may occasionally be unavailable, for example for maintenance or because of a supplier's failure. We give notice of planned maintenance as set out in the Support policy.

8.2 Support is provided as described in the Support policy, with response targets by plan. Response targets are targets, not guarantees.

9. Suspension

9.1 We may suspend access, in whole or in part, if we reasonably believe it is necessary to protect the service, other customers or anyone's data (for example, a compromised account or a security attack), if you seriously break section 7, or if the law requires it.

9.2 We tell you as soon as we can, say why, and restore access as soon as the reason has gone. Suspension never deletes your data, and you can still ask us for an export.

10. Our responsibility to you

10.1 Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

10.2 We are not liable for loss of profits, revenue, business or goodwill, or for any indirect or consequential loss.

10.3 Otherwise, our total liability to you under or in connection with these terms in any 12 months is limited to the greater of the fees you paid us in those 12 months and £100. Liability under the Data processing agreement is subject to the same limit, except where the law does not allow it.

10.4 TutorMaestry is a tool. You remain responsible for your business decisions, the invoices you send, the reports you share with families, and checking that what the AI drafts is right.

10.5 The service is provided with reasonable skill and care. Beyond that, and to the extent the law allows, we give no other promises about it.

11. Ending the agreement

11.1 You can close your account at any time by asking us at [CONFIRM: support email]. Moving to Free is not closing your account.

11.2 When the account is closed: export your data first (we can help); we then delete your instance and its data within 30 days, and backups expire within their 10-day cycle, as the Data processing agreement sets out.

11.3 We may end these terms by giving you at least 90 days' notice, or at once by notice if you seriously break them and do not put it right within 14 days of being asked. If we end them without your having broken them, we refund any fees paid for the time after they end.

11.4 Sections 6, 10, 11 and 13 survive the end of the agreement.

12. Changes to these terms

12.1 We may update these terms, the Data processing agreement and the other documents at /legal. For any change of substance we publish the new version, with a summary of what has changed, at least 30 days before it takes effect, and show a notice in the app.

12.2 When the new version takes effect, the account owner is asked to agree to it before carrying on. If you do not agree, you can export your data and close your account before it takes effect, and we refund any fees paid for the time after that.

12.3 We may make a change sooner where the law requires it or to fix a security problem, and tell you as soon as we can.

13. General

13.1 These terms (with the documents they refer to) are the whole agreement between us about TutorMaestry.

13.2 Neither of us is responsible for delays caused by events outside our reasonable control.

13.3 You may not transfer these terms without our agreement. We may transfer them to a company that takes over TutorMaestry, on notice to you, without reducing your rights.

13.4 If any part of these terms is found unenforceable, the rest stays in force. Not enforcing a right straight away does not mean giving it up.

13.5 No one else has rights under these terms under the Contracts (Rights of Third Parties) Act 1999.

13.6 Notices to us go to [CONFIRM: support email]; notices to you go to the email address of the account owner.

13.7 These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
